New Law Affecting Residences Signed by the Governor

On July 10, Governor Ige, signed H.B. 830 (224) into law, which amends chapter 6E-42 Hawaii Revised Statues (HRS). Effective July 1, 2015, applications for a proposed project requiring a County permit on an existing privately-owned, single-family detached dwelling unit or townhouse will only be subject to State Historic Preservation Division (SHPD) review under Chapter 6E-42 HRS if the single family, detached dwelling unit or townhouse is:

    1. Listed on the Hawaii and or national register of historic places; or
    2. Nominated for inclusion on the Hawaii and or national register of historic places; or
    3. Located in a historic district

Act 224 exempts all other projects for renovations or improvements to privatley-oned, single-family detached dwelling unti or townhouse that requires a County permit from SHPD review. ADUs, in concept, are consistent with existing AIA Honolulu Public Policy but at our February 2015 Board meeting concerns were expressed that ADU construction would result in overbuilding and “blight” of neighborhoods and Questor Lau will address these concerns in his slide show presentation.   Read more background information about this talk and some ADU history - provided by Scott Wilson, AIA, 2015 President.
